Welcome to the Nasse MC website (the "Service"), operated by Nasse MC ("us", "we", or "our"). These Terms of Service ("Terms") govern your access to and use of our Service, including any content, functionality, and services offered on or through https://nassenomads.club.

1. Eligibility and Membership

This Service is offered and available to users who are 18 years of age or older and meet the membership requirements of Nasse MC as outlined in our club bylaws or membership application process. By using this Service, you represent and warrant that you are of legal age to form a binding contract with us and meet all of the foregoing eligibility requirements.

Membership in Nasse MC is subject to approval according to club procedures. Registration on this website does not guarantee membership. Specific details regarding membership, dues, conduct, and responsibilities are governed by the Nasse MC club bylaws, which will be made available to approved members.

2. Changes to the Terms of Service

We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter. Your continued use of the Service following the posting of revised Terms of Service means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

3. Accessing the Service and Account Security

We reserve the right to withdraw or amend this Service, and any service or material we provide on the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

We have the right to disable any username, password, or other identifier, whether chosen by you or provided by us (including those associated with Google Sign-In), at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Service or club bylaws.

4. User Conduct and Responsibilities

As a user of the Service and a member or prospective member of Nasse MC, you agree to:

  • Abide by all applicable local, national, and international laws and regulations.
  • Uphold the values and code of conduct of Nasse MC, promoting respect, brotherhood, and safe motorcycling.
  • Not use the Service for any unlawful purpose or for the promotion of illegal activities.
  • Not engage in any activity that could harm, disable, overburden, or impair the Service or interfere with any other party's use of the Service.
  • Not post or transmit any content that is harassing, defamatory, obscene, pornographic, abusive, or otherwise objectionable, or that infringes upon the rights of others.
  • Respect the privacy of other members and not misuse any personal information obtained through the Service, as outlined in our Privacy Policy and Member Contact Disclaimer.
  • Ensure any content you contribute (e.g., forum posts, parts listings, event comments) is accurate and not misleading.

The Nasse MC name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Nasse MC or its affiliates or licensors. You must not use such marks without the prior written permission of Nasse MC.

6. Content You Provide (e.g., Parts Exchange, Forum Posts)

If you post, upload, or otherwise make available any content on or through the Service ("User Content"), you grant Nasse MC a perpetual, non-exclusive, worldwide, royalty-free, fully paid-up, sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display such User Content in connection with operating and promoting the Service and the club.

You represent and warrant that you own or control all rights in and to the User Content and have the right to grant the license granted above to us.

We have the right, but not the obligation, to monitor, edit, or remove any User Content for any or no reason, including User Content that we believe, in our sole discretion, violates these Terms or is otherwise objectionable.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER NASSE MC NOR ANY PERSON ASSOCIATED WITH NASSE MC MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE.

WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE SERVICE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICE OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT.

8. Limitation on Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL NASSE MC, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, OFFICERS, OR MEMBERS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

9. Indemnification

You agree to defend, indemnify, and hold harmless Nasse MC, its affiliates, licensors, and service providers, and its and their respective officers, directors, members, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms of Service.

10. Governing Law and Jurisdiction

All matters relating to the Service and these Terms of Service, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of Norway without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Service shall be instituted exclusively in the federal courts of Norway or the courts of [Specify Region/City in Norway, if applicable]. The Terms of Service, our Privacy Policy, and any club bylaws or specific membership agreements constitute the sole and entire agreement between you and Nasse MC regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
